There Still Is the Matter of High Crimes!

Once again the Bush/Cheney Gang has pulled the strings and the media and all the rest of us have taken our eyes off the most important story. The crime that has been committed.
Mr. Bush, Mr. Cheney and Mr. Rove are so good at this. As I have written in a previous Article, whenever a true and very harmful story about them bursts upon the scene, they always release something more terrible. To focus our attention, small as it is, on what they deem as a throwaway story. Just enough to do the job, but not enough to really harm them.

In the past, all they had to do was raise the terrorist alert, until they cried wolf once too often and nobody believed that anymore. The next time it was Mr. Cheney shooting a man and not reporting it, as the law required, and that got the Libby story off the front pages and off the airwaves.

Now, Mr. Fitzpatrick has released some very damning information. They covered that up with the statement that Mr. Bush had declassified the NIE report, so there really was no crime here. That worked for awhile.
But, two things about that. One, he declassified it ten days after authorizing Mr. Libby to leak it to reporters. Two, Ms. Plames name was not in that report. I do not believe that even Mr. Bush has the authority to out a CIA operative’s name. Nor does his father and mother, although not much brains there. The apple does not fall far from the tree!
Okay, that one was gaining some ground with the media and so it was an almost nothing story now.

But once a few of us wrote about the actual crime which had been committed, which is High Crimes committed by both Mr. Bush, Mr. Cheney and Mr. Rove, they had to come up with a story which would scare us so badly, that all of our senses would be focused on it. Something so outrageous that it would stop the world in its tracks.

What to use? Oh, how about “Mr. Bush was thinking of bombing Iran. And he was not taking the nuclear option off the table”, even though the Generals were demanding that they were. Horror! Unthinkable!

So what was the High Crimes that they committed, that they had to get us to stop talking about, to stop investigating? Both Mr. Bush, Mr. Cheney and at least Mr. Rove, and how many others within this Administration, had been interviewed by the Federal Prosecutor and they lied to him.

Did you know that it is a crime to tell a lie to the federal government? Even if your lie is oral and not under oath? Even if you have received no warnings of any kind?…… Even if the government is not actually misled by your falsehood? Well it is.

Title 18, United States Code, Section 1001 makes it a crime to: 1)knowingly and willfully; 2)make any materially false, fictitious or fraudulent statement or representation; 3)in any matter within the jurisdiction of the executive, legislative or judicial branch of the United States.

Your lie does not even have to be made directly to an employee of the national government as long as it is “within the jurisdiction” of the ever expanding federal bureaucracy. Though the falsehood must be “material” this requirement is met if the statement has the “natural tendency to influence or [is] capable of influencing, the decision of the decisionmaking body to which it is addressed.” United States v. Gaudin , 515 U.S. 506, 510 (1995). It is not necessary to show that the government was actually deceived or misled. Though you must know that your statement is false at the time you make it in order to be guilty of this crime, you do not have to know that lying to the government is a crime or even that the matter you are lying about is “within the jurisdiction” of a government agency. United States v. Yermian , 468 U.S. 63, 69 (1984). {Source}

Mr. Bush and Mr. Cheney were interviewed for seventy minutes, together and even though they were, by their own demands, not under oath, it is still a felony to lie to an investigator, either a Federal Prosecutor (isn’t Mr. Libby being charged with that one?) or the FBI.
Is this covered under Title 18, United State Code, Section 1001 or any other section? Yes!

I warned you that they would have to come up with some horrible story, to cover their asses on this one. A “terrorist attack” somewhere or start a war.

I am guessing that the war option was not on the table. Too many Generals are standing up against Mr. Bush and for the Constitution and our country.
Even though we have special, secret troops in Iran already, which is an illegal act of war, Mr. Bush just could not pull off another stupid war. Unless Iran does something really stupid, or they can make it look like Iran has done it, that war may never happen.
Now that this Bomb Iran story has scared us, they need to get that story off the media’s mind and so what story was back on the news Sunday? The missing Natalee Holloway girl. An arrest in the case was blasted all over the media. But if you listened carefully, it was not that they had found and arrested the supposed killer. No, they arrested a person who they want to interview. Yes, stop the presses, they want to talk to this person, and in Aruba, you arrest a person, so that you can interview them. This is still on the “news” today.

Between the Holloway story and the weather. The Duke Rape story, the terrible killing of children, we may never get back to “the story”.
Do not forget the crimes. This Administration has gotten away with everything. They skirt around, knowing that the American media and therefore the American people will be easily lead away from the truth.

The important truth. Mr. Bush, Mr. Cheney and at least Mr. Rove lied to the Federal Investigator. That is a High Crime. Impeachable action. We must demand that the Rule of Law is followed. It will never happen until and unless we get noisy and let the Congress know that we will not take it anymore!
This is the story of our country. Not the century, but our country. If they are allowed to get away with this, we will have helped destroy our country. We are supposed to be a country of laws, not man. Mr. Bush, Mr. Cheney, Mr. Rove and all the rest of this gang can not be allowed to do what you and I can not.
Most of us have never taken an oath of office, but they have! We must demand that they be held to that oath. We must demand that our Constitution be preserved. We must demand that they either step down or be removed. They have broken the law, the Constitution and our trust.
It is time!
